Kudirat Abiola: Al-Mustapha,Shofolahan, To Die By Hanging

Justice Mojisola Dada of a Lagos High Court this evening sentenced former Chief Security Officer, CSO, to the late General Sani Abacha, Major Hamza Al-Mustapha and Lateef Sofolahan to death by hanging for their roles in the murder of Alhaja Kudirat Abiola, wife of the late Chief MKO Abiola.
Shofolahan was the personal aide to the late Kudirat.

The court held that from the evidence before it, it was established that Al-Mustapha gave arms and ammunition to Sergeant Barnabas Jabila a.k.a. Sergeant Rogers, from Abuja to Lagos and provided logistics from Abuja to Lagos to meet Shofolahan to murder Kudirat Abiola.

In the judgement which lasted about eight hours, Justice Dada said the evidence provided by the prosecution were manifestly reliable and that the defendants murdered Kudirat Abiola.
She said the prosecution has proven its case beyond any reasonable doubt.
Responding to the verdict, the lead counsel to Al-Mustapha and Shofolahan, Mr. Olalekan Ojo said his clients will appeal the judgement.

Al-Mustapha’s supporters who besieged the court were confused and speechless after the eight-hour judgement was delivered.

The convicts were whisked away by security agents after the judgement was delivered.
Al-Mustapha, the former chief security officer to the late military head of state, General Sani Abacha, and Sofolahan were tried on a two-count charge of conspiracy and murder.

The men were alleged to have been involved in the 4 June, 1996, murder of Alhaja Kudirat Abiola, wife of the late businessman and politician, Chief Moshood Kashimawo Abiola.
The trial suffered several adjournments as a results of numerous applications that needed to be resolved before trial.

During the trial, state’s key witnesses, Sergeant Barnabas Jabila (aka Rogers), and another soldier, Mohammed Abdul (aka Katako), recanted on their roles in the alleged murder and how the crime was committed.

They had earlier told the court that Sofolahan, acting as Kudirat’s aide, gave them information on her itinerary, which aided them in accomplishing their task of eliminating her. Kudirat was on her way to the American embassy on the day she was killed at the Toll Gate end of the Lagos-Ibadan Expressway. The Lagos government under the Tinubu administration had built a cenotaph near the scene of the murder.
Jabila, a member of the special security outfit established to protect Abacha and his family, had also confirmed he fired the shot that killed Kudirat, while Abdul, who served as personal driver to Mohammed, narrated how they (himself and Jabila) went out the day after meeting Sofolahan, trailed a white Mercedes Benz car from Ikeja to the old Lagos toll gate and how Jabila shot at the car and directed him to drive back to Dodan Barracks where they were staying.

In his evidence-in-chief, Jabila narrated how he was, some days before Kudirat’s assassination, summoned by Al-Mustapha to his office in Aso Rock, handed some bags containing guns, and briefed on “ a special assignment”.

He also told the court that Sofolahan provided them with information about Kudirat’s movement and even led them to her residence after which his team planned strategies for the operation.
Jabila also said Sofolahan’s information aided them in trailing Kudirat until he shot her on 4 June, 1996 in the car driven by Abdul.
Abdul, who acted as the prosecution’s third prosecution witness, corroborated Jabila’s testimony.

He said he once worked with Mohammed’s late senior brother, Ibrahim, but had his service transferred to Mohammed after the latter’s death.
The revelations were stunning but with time and after the matter had passed through several judges, Jabila and Abdul recanted during cross-examination, denying all their earlier evidence.

They later blamed their strange decision to somersault on their allegation that the state reneged on its promise to compensate them materially after the trial.
They alleged that the state failed to fulfil its promises, under the witness protection programme, to reward them and their families for acting as prosecution witnesses.

The case also suffered some hiccups after the fourth prosecution witness, Yusuf, who allegedly obtained statements from Al-Mustapha during investigation, also, midway into his testimony, refused to cooperate with the prosecution.

He allegedly refused to attend court, a development that forced the court to close the prosecution’s case in July after several adjournments.
Opening his defence, Al-Mustapha who witnessed for himself, denied all the allegations against him. He particularly denied sending anybody to kill Kudirat. Apart from this, he denied any knowledge of sending any emissary or sponsored anybody to kill the victim and also monitor the activities of NADECO members.

But he was confronted with his statement, from which he read to the court a portion, where he admitted sending Rabo Lawal to monitor a NADECO rally in Lagos. On Kudirat, the prosecution confronted him with a statement by Mohammed Abacha, contained in the Supreme Court’s judgment in an interlocutory appeal by Mohammed, and upon which he was freed.

In the statement, part of which was read to the court by the lead prosecution lawyer, Lawal Pedro, SAN, Mohammed admitted witnessing where Al-Mustapha gave Jabila a bag containing guns.
This was vehemently opposed by Al-Mustapha’s counsel, Mr. Olalekan Ojo.
Also, Al-Mustapha, who earlier testified not to have tortured anyone in his life, later admitted, during cross-examination, that he tortured Turner Ogboru.

He also admitted that, as trained military personnel, he could take lives in public interest. The defence also called a retired army personnel, Kyari Gadzama, who worked as an aide to Al-Mustapha, who testified in his favour.

He admitted knowledge of Kudirat’s assassination, but said he heard of it from media reports. He also denied accompanying his ex-principal always to every of his engagements and meetings.

In his own testimony on 17 August, 2011, which almost turned the court into a theatre, Sofolahan, the third defence and last witness, also testified for himself. In his own testimony, he denied involvement in the offences for which he was accused.

To the chagrin of those present in court, he denied ever working for any member of Abiola family or was a personal assistant to Kudirat.

7 Ways to Turn your Friendship into Love

Many times, the best way to find true romance is to build a love friendship out of an existing relationship you have with someone you know. For instance, think of the true romance of Monica and Chandler on NBC’s Friends where you watched love friendship grow. Of course this was just a TV show, but the magic of the love friendship was that it was so perfect and a picture of two people just like us, who built a true romance out of their existing friendship. Therefore, true romance could be looking right at you in your love friendship, but you may need to work to develop it some, so here are seven ways to turn your friendship into love.

Dress to impress - Oftentimes when you get comfortable being around a friend for too long, you forget that true romance starts with getting the other person to see you as a sexual being, and not just as one of the guys or girls so you need to get them looking at you in a love friendship kind of way first if you ever want true romance to ever develop.

Online flirting - If you are too shy to use true romance tactics, you might try borderline flirtatious comments out when you are Instant Messaging the person you want the love friendship with. At first she or he may take them as a joke, but this person of your love friendship tactics, is eventually going to start to wonder on their own if true romance could be a possibility.

Flirting in real life - Pretty obviously the follow-up in trying to find true romance with the friend you want to have the love friendship with. It’s a great way to follow-up and really leave them wondering about you and them in terms of true romance and a love friendship.

Show interest in other people - Jealousy is a great way to get the person of your love friendship interests to see you both as a true romance prospect as they realize you have needs outside of being their friend. Oftentimes, they may realize they do have feels of love friendship towards you when they begin to question why your behavior is making them so jealous.

Make yourself scarce for a bit - Nothing will help them to notice you more, when they realize you are not always around like they area use too. When they start to notice your absence in their life, they may begin to question if perhaps there is room for true romance in your love friendship.

Become vital in their lives - On the flip side, you could make sure they see your love friendship possibilities by making sure you are part of every big part of their lives, so they ralize how lost they would be without you. This may cause them to start thinking maybe you too do have the makings for true romance.

Make the move - Eventually, shy or not, someone is going to have to make the move if you want this to turn into true romance and a love friendship.

Guard Murders Recharge Card Seller Over N24,000 Debt

The police at Dolphin Estate Division, Ikoyi, Lagos State, Southwest Nigeria, have arrested a security guard who also sells recharge cards for allegedly stabbing his customer to death.

The victim, simply called Benjamin, had gone to demand for the balance of the money the guard was owing him for the recharge cards the deceased sold to him when the incident happened.

The incident occurred at about 9 am at 273B, Corporation Drive, Dolphin Estate, Ikoyi, Lagos.
Eyewitnesses at the scene of the incident told P.M.NEWS that the guard identified as Onuabuchi John, allegedly stabbed the victim in five places on the head and face when the victim who has been supplying him recharge cards came to demand for the balance of N24,000 Onuabuchi was owing him.

The guard, it was learnt, engaged the victim in an argument which soon degenerated to a fight during which he went inside his security post, brought out a kitchen knife and stabbed the victim several times.
The victim slumped and died on the spot.

The guard, it was further gathered, after killing the victim, dragged the corpse underneath the staircase of the office complex.

He covered the corpse with a rug and subsequently stabbed himself to look as if it was a robbery incident.
Nemesis, however, caught up with him when his employer’s shop assistant saw him as he made to escape from the compound the victim’s bag.

She was said to have raised an alarm which attracted neighbours who pursued and caught up with him.
The police at Dolphin Police Station and the DPO SP J. S. Musa were invited. He led his team to the scene of the incident and arrested the suspect.

Items recovered from the suspect, according to a police source, include a kitchen knife and the bag of the victim, containing recharge cards worth thousands of naira and unspecified amount of money.

During preliminary interrogation, the suspect allegedly confessed to the police of stabbing the victim to death for disturbing him about the N24,000 he was owing him.

“I am from Ebonyi State, a private security guard. The victim Benjamin has been supplying me recharge cards for some months now. I have been faithful in paying him his money without any misunderstanding.
“On the day of the incident, the victim came to demand for the balance of his money and I told him to come back, but instead he started shouting in the compound and a fight broke out.

“In the process, I didn’t know what came over me and I picked a knife and stabbed him till he died.
“I regret my action and I promise not to listen to the voice of the devil in my life if I am set free in this case,” he pleaded.

When P.M.NEWS visited the scene of the incident, the gate of the building was padlocked and at the Dolphin Police Division, the DPO was not available for comments. He was said to have gone to Ikeja Police Command.

A police source confirmed the incident and said the corpse of the deceased has been deposited in a morgue, while the suspect has also been transferred to the State CID, Panti, Yaba, for interrogation.
When P.M.NEWS visited the State CID Command, the presence of the suspect was also confirmed by the police.

All efforts made to see the family of the deceased proved futile.

Jonathan didn’t contest AU chairmanship – Presidency

President Goodluck Jonathan has debunked reports in a section of the media that he contested the AU Chairmanship position and lost to President Yayi Boni of Benin Republic at the 18th AU summit held in Addis Ababa.

In a statement, Monday,  by Special Adviser to the President (Media and Publicity),Reuben Abati; ” It is not true that President Yayi Boni “defeated” President Goodluck Jonathan in an election; there was no contest in the first place and President Jonathan was not a candidate for the AU Chairmanship position.”

The statement reads,” It is also not true that President John Atta Mills opposed President Jonathan at any time. Ghana and Nigeria enjoy excellent relations. It is true, however, that in the last week, some newspapers have been speculating that President Jonathan may be adopted  by the ECOWAS Heads of States and Governments to be the next chairman of the African Union, since it was the turn of ECOWAS to produce the AU Chairman for 2012-2013. Mr. President was indeed approached by leaders within and outside the West African sub-region to take up the challenge of leading the AU for the next one year.”

” But the President while appreciating this kind gesture, that he needed time to focus on domestic affairs in Nigeria, and that it would be practically difficult for him to combine the three positions of President of Nigeria, Chairman of ECOWAS and Chairman of African Union. He therefore rejected the offer. ”

“In order to make his position clear, President Jonathan, in his capacity as ECOWAS Chairman, summoned a mini-Summit of ECOWAS at the AU Commission Headquarters on Saturday, January 28, 2012, to ensure that there was a meeting of minds on the position of AU Chairman.  His preference, he noted, would be for ECOWAS to adopt the leader of another country, in order to promote a sense of belonging among member-states. Nigeria, having occupied the position of AU Chairman four times in the past, would readily support any such country.”

Abati also affirmed that “President Jonathan rather than being “defeated” by President Yayi Boni of Benin actually facilitated his emergence as AU Chairman via his unanimous adoption by the ECOWAS Heads of State as the sub-region’s candidate for the AU Chair.”

Kudirat Abiola Death: Judgement day for Al- Mustapha, Shofolahan

A Lagos High Court presided over by Justice Mojisola Dada, will today deliver judgement in a criminal suit instituted against the former Chief Security Officer, CSO, to the late Head of State, General Sani Abacha, Major Hamza Al-Mustapha and Alhaji Lateef Shofolahan over the alleged assassination of Alhaja Kudirat Abiola. During trial, al-Mustapha through his counsel, Olalekan Ojo, argued that the prosecution has failed to prove its case beyond reasonable doubt.

Adopting his 112-page written address dated September 16, 2011, the defence counsel said, Having regard to the totality before the court, it cannot be said that the case of the prosecution against the defendants has been proved beyond reasonable doubt. It is more that 13 years now when the defendants have been in custody and by prison calendar it is about 18 years. Even if some people wanted him punished, by now they should be satisfied that he has been given enough punishment.

Specifically, he argued that Al-Mustapha had told the court that he was a victim of persecution, detailing how he had been targeted by the powers that be and gave reasons why the animosity was so intense. He told the court that there was nothing unlawful in what Al-Mustapha has done, adding that when he (Al-Mustapha) learnt that the property of General Abacha was to be burnt, he sent Rabo Lawal to find out and contact other security agencies in Lagos State to protect the property.

In his reply, Lawal Pedro SAN, the Solicitor General of Lagos State told the court that Sgt. Rogers (PW2), had earlier told the court how he killed the late Kudirat, adding that there are circumstantial evidence that linked the two defendants with the prosecution witnesses.

He submitted that each of the defendants may not have shot Kudirat Abiola or be present at the time she was shot, yet they could be found guilty for her murder. He submitted that it was the information provided by the 2nd defendant that enabled them to trace her and shoot her. He argued that there was a meeting of the minds between Rogers, Katako and the defendants and urged the court to take judicial notice of the reign of terror that pervaded the country when

President Yayi Boni Of Benin Republic "Defeats" Nigeria's Jonathan To Become AU Chairman

The President of Benin republic, Yayi Boni, has been elected as the chairman of the African Union (AU) after a group of West African nations led by Ghana opposed the candidature of Nigeria's President Goodluck Jonathan.
Boni will be taking over the chairmanship of the African Union (AU) from Equatorial Guinea's dictator Teodoro Obiang Nguema.

Mr. Jonathan had injected himself into the contest as a last minute attempt to become the chair of AU but his effort was stoutly opposed by Ghana leading several West African nations that claimed Mr. Boni's nomination was already agreed upon at a mini-summit of the Economic Community of West African States (ECOWAS).
It was not clear if Mr. Jonathan withdrew his candidature after ECOWAS member states blocked his bid to become the AU chair. However, Mr. Boni was announced as the new chair of the African Union and takes over as Chairman at the 18th AU Summit in Addis Ababa today.

Revealed! How Genevieve Nnaji, Omotola’s supremacy war nearly ruined Ije

Startling facts have emerged concerning how the age-long feud between actress Genevieve Nnaji and Omotola Jalade-Ekeinde played out during the production of Chineze Anyaene’s multiple award winning movie, “Ïje: The Journey.”

The silent rivalry, HVP gathered nearly ruined the production of the big budget movie.
The movie which ruled the Nigerian box office, grossing over N47 million from six cinemas across the country two years ago starred the two A-list actresses amongst other Nollywood stars.

Sources close to the producer  told HVP that, while the movie was being shot in Los-Angeles,  it was a running battle to get the two heavy-weight actresses to work as a team.
In fact, according to our sources, except for the ceaseless intervention of the cast and crew of the production, none of the two actresses was ready to play a second fiddle to each other.
Genevieve, Chineze and Omotola

“At a point, we stopped shooting because they wouldn’t submit to each other. Chineze had a tough time trying to appeal to them to show understanding by returning to the set. Omotola wouldn’t want to play supporting role to Genevieve. And that was the battle we faced during the production of  the movie.” our sources hinted.

In the movie however, Genevieve played the role of Chioma, the lead character, while Omotola played that of Anya, her  sister.

Indeed, before starring in the movie, Omotola and Geneveive were known to be engaged in a cold war, resulting from the so called “insults” traded through the media and an alleged battle to be Nigeria’s Number one sex symbol.

In one of her interviews, Chineze was quick to explain how she got the two actresses to star in the movie.“ I met Omotola first in Lagos; she had read the script and liked it. I also went to England and met with Genevieve Nnaji. I also had Zeb Ejiro, the consulting producer, step in as well as a mediator,”  she said.
Our sources went further to reveal that despite the record the blockbuster created in the nation’s box office,  grossing over N47,  the windfall did not reflect on the producer’s pocket. The cinema houses were said to have taken the lion’s shares of the accruing profits made from the cinema run of the movie.

It would be recalled that druring the first month of the movie’s premiere in July 30, 2010, at Silverbird Cinemas, the blockbuster grossed over N25 million, beating the record set by Stephanie Okereke’s “Through the Glass”, which grossed only N10 million, during the first-three weeks of its premiere at the same venue few years ago.

BOMBSHELL! Dickson Iroegbu releases gay movie

…as Mike Ezuruonye, Desmond Elliot shun film
Controversial movie producer and director, Dickson Iroegbu who is known for his “astuteness” is set to cause ripples again in the society as he concludes plans to release his latest movie, “ Law 58” into the market.

“Law 58” is an expository, yet shocking movie on gay practice and its consequences on the traditional African society.

The producer claimed that the movie, which stars the likes of Kanayo. 0.Kanayo, who played the lead character, Clarion Chukwurah, Halima Abubakar, Ghanaian actor, Kofi Adjorlolo, Mark Morris Chibueze amongst other Nollywood stars took him over four years to produce.
Dickson Iroegbu

Iroegbu also disclosed how actors like Mike Ezuruonye and Desmond Elliot refused to be part of the eyesore movie when he approached them to star in it.

In a chat with HVP, during the week, the light-complexioned director, who recently staged a comeback to the motion picture industry after few years of abandoning the trade, said the movie will be released on DVD as from next month. For him, the movie will relaunch him into the mainstream movie making.
Narrating how he came about the movie, Iroegbu said “Law 58″ was the last movie he made before he  proceeded on sabbatical few years ago.

He,  however recalled how he was once called a gay, and accused of telling his own story because of his decision to produce the film, adding that  by the time the film hits the street, the world will acknowledge “whether I am a gay or not.”

According to him, the movie  was produced between 2008 and 2009 .”When I saw the National Assembly debate on Gay Marriage, I thought it was prophetic because at the  time, I produced the movie, we hadn’t engaged ourselves constructively on how to address the issue of gay.

“We  pretended then as if it didn’t exist in our society.  Not knowing that it was gradually eating into the fabrics of the society.”

“So, one saw it at that time and set out to discuss it via the tube. I may sound very judgmental about it but I have no apologies whatsoever. Homosexual is an evil act that our culture and religion as Africans prohibits,  and so, speaking against it as a film maker is to re-echo what my society has been saying about the ugly practice.”

“At the time, I was shooting the movie, most of my colleagues frowned at the project because it was rumour  then  that some of them were involved in the act. I thought it was time to take a stand, given the fact that  I was once called a gay ,just to discredit my personality.”

“Today, I want the society to feel my purse differently, so that when the film is finally released into the market, they will be able to reconcile it with the Dickson Iroegbu they have known for several years. The world will also ascertain whether I’m a homosexual or not.”

When asked why it took him some time to release the movie, Iroegbu replied, “  it was as a result of some personal issues which I needed to address as well as  the the censors board’s refusal to certify the movie on the ground that it dwells on an issue that is not allowed in Nigeria.

The board also demanded that I should go back  and re-edit the film, which I did. It was supposed to be a two-part film, but they insisted that I must reduce it to a one-part film. At the moment, I have fulfilled all the  board’s requirements and I have  given a nod to release the film.”

On starring KOK as the lead character, the controversial movie director expressed sympathy for the actor. He said, “ I know how I tried to convince him to get involved in the movie. It took KOK some time before he agreed to star in the movie.

“Also, I approached actors like Mike Ezuruonye and Desmond Elliot, but   they screamed, and turned down the offer to star in the movie. For whatever reason they refused, I don’t know.” The movie, according to Iroegbu, explores a true life story.

EFCC to probe sacked governors

FOR allegedly mismanaging the finances of their states, the Economic and Financial Crimes Commission (EFCC) will go after some of the five former governors who were sacked by the Supreme Court on Friday.
The commission, at the weekend, disclosed plans to  invite some of the governors to answer questions regarding  management of state finances during their tenure in office amid speculations that some of them may be on their way out of the country to escape investigations by anti_graft agencies.

Sunday Vanguard gathered that a host of the governors did not have ample time to tidy their books before they were booted out of office, a situation that may afford the anti-graft agencies room to nail them. With two favourable judgments in their kitty, some of them stormed Abuja ahead of the judgment, on Friday,  expecting the Supreme Court  to approve their elongated tenures but they were  heavily disappointed. Indeed, some of the former governors are not in good terms with the Speakers, who succeeded them as acting governors.

EFCC Acting Head of Media and Publicity, Mr. Wilson Uwujaren, said  “some of the ousted governors may have a case or two to answer with the commission. Already, we have pending petitions against these governors, and we will be inviting them to make statements, then we will take it up from there.”
This came as Adamawa State erupted in jubilation over the ouster of former Governor Murtala Nyako and Speaker of Sokoto State House of Assembly, Alhaji Lawali Zayyana, was sworn-in as acting governor to replace sacked Aliyu Wamakko.

Meanwhile, as the acting governors marked their first day in office, mixed reactions continued to trail the apex court’s axing of the governors yesterday. Aside Nyako and Wamakko, the other ex-governors removed are Timipre Sylva (Bayelsa), Ibrahim Idris (Kogi) and Liyel Imoke (Cross River).
Probe

Uwujaren would not confirm reports that any of the former state executives has left the country.
However, a reliable source in  the EFCC stressed that the anti_graft agency was resolved to bring corrupt former leaders to book, no matter where they run to or how long they run, saying: “We are not being slack (over corrupt ex-governors).

I can assure you that we will do the right thing by investigating the petitions, but we will not be pressured into opening up the extent in order not to compromise our work. Nigerians should be rest assured that we will go after former governors that have cases to answer with the Commission,, wherever they may be. In the coming days, we will let the public into what we are doing and how far we have come.”
The source added that EFCC was “ready to do whatever is necessary and legal” to bring the former governors and their cohorts to account for allegations of financial misconduct.

Meanwhile, the House of Representatives Committee on Drugs, Narcotics, Financial Crimes and Anti_Corruption, on Friday, called for enhanced funding of the activities and operations of the EFCC.  Chairman of the Committee, Honourable Jagaba Adams Jagaba, made the call at a meeting where the acting chairman of the EFCC, Mr. Ibrahim Lamorde, presented the commission’s budget proposal to it.
A proposal of N10.9billion, as allocated by the Budget Office of the Federation, was presented.  He specifically called for the intervention of the committee to correct the zero allocation in respect of Legal Services, Forensic Laboratory, Information and Communication Technology and Life Insurance for the staff of the commission.

Jagaba expressed support for the work of the EFCC and assured the EFCC of the cooperation of his committee to address the shortfall in the allocation made by the Budget Office.
Jubilation in Adamawa as Marwa returns
For over three hours, on Friday night, the road leading from the Yola Airport to General Mohammed Buba Marwa’s house, which is about 15 kilometers, was blocked as jubilant indigenes of Adamawa State trooped out in large numbers to give him a triumphant return from Abuja. Marwa, the Congress for Progressive Change (CPC) Adamawa guber candidate contested the tenure elongation verdicts of the lower courts upto the Supreme Court.

As he alighted from the airport, taxi drivers, private vehicle owners, Okada riders joined his convoy and took over Yola roads. There were shouts of “Change Dole”, “Change Yazo” while many celebrated that Marwa was instrumental to liberating Adamawa people from the bondage of Nyako’s Administration. Shocking scenes were to follow with some of his supporters displaying placards of a major opposition candidate in the February 4 election, calling for his withdrawal for failing to improve the lot of the state.
Security operatives who were on hand to control the situation became overwhelmed as the crowd continued to swell at every turn along the way. Luckily, no casualty was recorded during the journey to his abode.
On reaching his house, Marwa told the jubilant supporters he was happy to have been the instrument God used to remove Nyako from oppressing them, adding that it was the signal that the change they want would materialize.

He told them that the mis-governance of the last five years would soon be corrected because resources allocated to the state would henceforth be put to fruitful use. The Acting Governor, Alhaji Ahmadu Adamu Fintiri, the former speaker of the State House of Assembly was shut out for over two months by Nyako, who was insisting that his loyalist and  impeached former Speaker, Ibrahim Sadeeq, must be returned.

Sokoto gets acting gov

Former Speaker Zayyana was sworn-in, yesterday, by the Chief Judge of the state, Justice A’ishatu Dahiru, in compliance with the provision of Section 191(2) of the Constitution of the Federal Republic of Nigeria, as amended. Speaking thereafter, Zayyana sued for peace, called for understanding of the people and urged them to go about their normal activities without let or hindrance.
Mixed reactions

Commenting on the judgment, Ebonyi State Attorney General and Commissioner for Justice, Dr. Ben Igwenyi, hailed the apex court’s decision and hoped that it would help the country achieve good governance. He also expressed regrets that the Supreme Court judgment on the tenure of governors did not come earlier than now saying that the tension being generated by the landmark judgment in certain states would have been eliminated.

Igwenyi, nevertheless, stressed that the judgement had put to rest the “anxieties, argument and antagonisms” that continued to trail the beneficiaries of re-run governorship polls in the five affected states after the flawed 2007 elections.

Relatedly, National Co-ordinator of Warri-based Forum for Justice and Human Rights Defence (FJHD), Oghnejabor Ikimi, who had last year approached a Federal High Court in Asaba for a proper interpretation of the tenure of the governor of Delta State, Dr. Emmanuel Uduaghan after his first tenure was truncated by the Court of Appeal, Benin City, said the latest judgment by the Supreme Court “has further deepened our fledgling democracy.”

However, 2007 and 2011 Peoples Redemption Party (PRP) governorship candidate in Delta State, Mr. Emmanuel Igbini, faulted the verdict, saying that it would create confusion in the polity.
In a statement made available to Sunday Vanguard in Warri, he said: “I do not agree with the judgment of the Supreme Court on this matter.

The fact remains that prior to the amendment of the Nigerian 1999 Constitution on January 10, 2011, the provision of Section 180(2) simply implies that any governorship election annulled by Court of Appeal and a re-run election conducted, the oath of office first taken is invalid, and unknown to law, despite the fact that policies and actions taken during the said invalid period remains valid. The reason for this is that the policies and actions taken are irreversible.

“However, I want to hasten to state that by this judgment of the Supreme Court, it follows that any governorship election to be held in the five affected states must be deemed to have been held on April 26, 2011 being the date fixed by INEC for fresh governorship elections.”

He continued:, “This judgment of the Supreme Court has now confirmed Timipre Sylva as PDP governorship candidate for the election to be held any time from now because by provision of Section 131 of the Electoral Act, 2010, he is the valid candidate for PDP in the January 2011 PDP Primary.

“For the benefit of doubt, Section 32(1) states that “every political party shall not later than 60 days before the date appointed for a general election under the provisions of this Act, submit to the Commission in the prescribed forms, the list of the Candidates the Party Proposes to sponsor at the elections”. The big question now is: who was PDP governorship candidate sent to INEC in January 2011? No doubt, there more confusion has been created by Supreme Court on Nigeria’s political scene.”

Kano, Maiduguri attacked again: 13 killed in Boko Haram, soldiers gun battle

*Igbo to kinsmen in the north: Relocate wives, children to south-east

By Tony Edike , AbdulSalam Muhammed & Ndahi Marama

No fewer than 13 people were at the weekend killed in the latest confrontation between the security forces and members of the Boko Haram sect.

The scenes of confrontation were Kano, the capital of Kano State, where 186 people were killed when the sect struck, penultimate Friday, and Maiduguri, Borno State capital.

At the end of the fresh Kano clash, on Friday, one police officer lay dead.
11 Boko Haram operatives were killed in the Maiduguri incident, yesterday.
Earlier yesterday, the sect operatives were credited with the killing of the youth leader of Borno State chapter of the ruling All Nigeria Peoples Party (ANPP) in the state capital.

The Boko Haram/security forces confrontation took place just as a section of Igbo leaders rose from a meeting in Enugu asking their kinsmen resident in the north to relocate their wives and children back to the south-east.

The Kano incident occurred at Mandawari  Police Division located about  900 meters to the palace of the Emir of Kano, Alhaji Ado Bayero
EXCHANGE OF FIRE
According to the state commissioner of police, Mr Ibrahim Idris, the gunmen arrived in two cars – a Peugeot and Volkswagen Golf – and motorcycle after which they opened fire on the police station.

In the ensuing exchange of fire from policemen, Idris, who spoke to journalists, yesterday, stated that one of his officers was killed.

The gunmen escaped.

The police commissioner revealed that the police recovered from the scene of the clash one AK 47 rifle and AND 3 magazine abandoned by the invaders.

He stated that the scene was littered with blood, an indication that the attackers escaped with bullet wounds.
The late evening shootout triggered pandemonium in the densely populated area of Kano metropolis as sporadic gunshots rented the air following the arrival of the military.

SULTAN VISITS

The shootout coincided with the visit of the Sultan of Sokoto who came to commiserate with the Emir of Kano over the penultimate Friday killings.

11 INSURGENTS DEAD

11 suspected Boko Haram members were, in the yesterday incident, killed after soldiers from the Joint Military Task Force (JTF) clashed with them in two wards of Maiduguri.
One member of the sect was arrested during the clash which reportedly lasted 15 minutes.
The arrested member, with injuries, according to security sources, was taken to the University of Maidiguri Teaching Hospital for treatment.

Before the clash, three gunmen suspected to belong  to the Boko Haram sect, attacked the Borno ANPP youth leader, Alhaji Atake, 32, near Mai-Deribe mosque in Bulunkutu ward of Maiduguri.
The gunmen shot him in the head and arm, killing him instantly.

‘TO THY TENTS OH IGBO’

Yesterday’s decision of some Igbo leaders to ask their kinsmen resident in the worth to relocate home their wives and children came against the backdrop of continued bombing by Boko Haram of public institutions including churches and homes in the north, which has claimed several lives and property of Ndigbo living in the affected areas.

Briefing newsmen shortly after the meeting held at the Enugu residence of  the late Chukwuemeka Odumegwu Ojukwu , leader of the Movement for the Actualization of Sovereign State of Biafra, MASSOB, Chief Ralph Uwazurike, and the former President General of apex Igbo socio-cultural organization, the Ohanaeze Ndigbo, retired Justice Ezebuilo Ozobu, said the call became necessary since the situation is getting worse.

“We can no longer keep quiet or fold our arms watching our brothers and sisters being slaughtered by members of the Boko Haram on daily basis in the North and buried in mass grave,” the Igbo leaders declared.
They stated that the number of innocent Igbos that are killed by the Islamic sect are under reported by the media.

According to Uwazurike, the leaders took a critical review of the unfortunate happenings in the North before taking their decision, and advised that such returnees who do not have places to stay to go to any of the refuges or resettlement centers already provided in parts of South East zone such as the one in Okwe, Okigwe in Imo state.

He also appealed to the international community, religious organizations, and wealthy individuals in Igbo land to come to the assistance of such displaced “fellow brothers and sisters” whom he said, “may be facing untold hardship upon their return back home”.

He further explained that a committee had already been put in place to discuss the ugly development with president Goodluck Jonathan .

He assured the returnees that more resettlement camps would be set up in various parts of Igbo land, advising the men folk and husbands to go back to their various locations in the North to man their businesses and always be at  alert.

As at the time of filing this report yesterday, Igbo elders, politicians and religious leaders were holding another meeting at Nike Lake Resort, Enugu with Governors of South East geo-political zone under the headship of Peter Obi of Anambra State over the insecurity situation in the North especially as it affects the Igbos residing in that part of the nation.

Their communique was being awaited at press time.

We’ll attack Sokoto, Boko Haram warns Sultan, Tambuwal, others

ABUL-Qaqa, the spokesman of the Jama’atu Ahlis Sunnati Lidda’awati Wal Jihad, also known as Boko Haram, yesterday, alleged that security agents have arrested “many” of its members in Sokoto and called for their immediate release.

He however, urged senior citizens in Sokoto and other neighbouring states to intervene in order to avert the replication of what he described as “the big attack in Kano State.”
Qaqa, who spoke to journalists on phone yesterday said: “This is an open letter to the emir of Sokoto (Sultan of Sokoto) Alhaji Muhammad Sa’ad Abubakar 111, the Speaker of the House of Representatives, Alhaji Aminu Tambuwal and the Acting Governor of Sokoto State.

“Before we visited Kano, we wrote open letter to senior citizens there on the imperative of releasing our members but nobody cares to talk. Indeed, we sent three warnings to Kano before we strike,” Qaqa said.
File photo: Boko Haram mulitiple attacks in Kano

“What happened in Kano will be inevitable in Sokoto unless you (Sultan and others) intervene and ensure the immediate and unconditional release of our members who were specifically arrested in the city of Sokoto on Thursday,” Qaqa said.
A rescue worker inspects the burnt-out wreckage of cars and motorcycles destroyed by multiple explosions and armed assailants in the Marhaba area in Kano.

Qaqa faulted the call for dialogue by President Goodluck Jonathan. “There is gross inconsistency in all the proclamations of the Nigerian leader. Our members are being trailed and killed on one hand, and on the other hand, some people are telling us to surrender our arms and come out. This is impossible,” he said.

PIP breast implant boss Jean-Claude Mas faces charges

The owner of a French breast implant maker that sparked a safety scare faces charges of "involuntary injury", his lawyer says.

He said Poly Implant Prothese (PIP) founder Jean-Claude Mas, 72, had been freed on bail of 100,000 euro ($130,000).

In 2010, France banned PIP implants made with the low-grade silicone, amid fears they could rupture and leak.

Up to 400,000 women in 65 countries are believed to have been given implants.

Mr Mas remained at his home in Six-Fours-les-Plages, in the South of France, while police searched it - as required by French law. He was later taken to the national police station in Marseilles.
'Nothing to say'

His lawyer, Yves Haddad, told AFP news agency: "He is not well, he is tired and he is waiting for his doctor."

Mr Mas has been under investigation since he revealed in a police interview last year that PIP ordered employees to hide the unauthorised silicone when inspectors visited its factory.

It was thought that he would be investigated for manslaughter but although Mr Mas is still considered a suspect, his lawyer told Reuters news agency that "on the charge of involuntary homicide [manslaughter], the judge decided that for now there is no link".

A lawyer representing women who had been fitted with PIP implants said he welcomed the arrest of Mr Mas.
"This is a relief. It's come late, but at least it's happened," Philippe Courtois said.

"He's been placed in preventive detention. Let's see in the coming hours what his interrogation by the investigating magistrate brings. But what we're really hoping for is his formal investigation, under remand in custody, just to make sure that he doesn't leave French soil during the investigation."

Mr Mas told police in an interview last year that PIP had deceived European safety inspectors for 13 years.

But he has insisted they posed no threat to health and attacked the French authorities for offering to pay for their removal because it put women through a "surgery risk".

He also said he had "nothing" to say to women facing surgery for their removal and that victims had only filed complaints "to make money".

Excerpts from Mr Mas's interview have been re-examined by a French magistrate.

In France, 30,000 women have been advised to remove the implants and 2,700 have filed complaints against Mr Mas.
'Medically necessary'

Women in 65 countries - mainly in Latin America and elsewhere in Europe - have received implants made by the company, which closed down in March 2010.

Health officials in Germany, the Czech Republic and Venezuela have advised women to have them removed.

But the medical advice in the UK, where 40,000 are affected, is that there is no need for all the implants to be removed, only those causing problems such as pain or tenderness.

In England, patients fitted with PIP implants by the NHS will have them replaced by the health service, while it will remove implants from private patients if their clinics refuse. The NHS in Wales said it would replace implants only when it was deemed medically necessary.

Debbie Lewis has paid over £6,000 to have her burst PIP implants replaced

Women in Northern Ireland who received PIP implants for health reasons will have them replaced, but the NHS will only remove, not replace, those inserted for cosmetic reasons.

Scotland's Health Secretary Nicola Sturgeon said concerned women who had them fitted privately would be offered advice and the option of removal if necessary. There are no records of PIP implants being used by the NHS.

On Thursday, two more private firms in the UK said they would remove PIP implants free of charge.

Transform, which has just over 4,000 UK patients with the implants, had originally said patients would have to pay for removal. It now says those who have had the implants fitted since 2001 can have free removal - but will have to pay around £2,500 for replacements.

Those who had replacements since 2006 may still be within their warranty period and would therefore get both removal and replacement for free.

The Hospital Group also announced it would offer free removal for patients who had PIP implants fitted between 2001 and 2009 - but would charge between £1,500 and £3,500 for replacements.

The international police agency Interpol has said Mr Mas is wanted in Costa Rica over a drunk driving charge.

It said the "red notice" over an alleged incident in June 2010 was "totally unconnected" to PIP.

Nigeria's Apex Court Sacks Five Governors

Five State Governors have been ordered by the Supreme Court sitting in Abuja to leave office.

The order came this morning in an unanimous decision of a 7-man panel headed by Justice Walter Samuel Nkanu Nnoghen. The panel ruled that their tenures had expired since May 29, 2011 and have illegally remained in office since then.

The five State Governors affected are Senator Liyel Imoke of Cross River, Admiral Murtala Nyako of Adamawa, Chief Timipre Sylva of Bayelsa, Aliyu Wammako of Sokoto and Alhaji Ibrahim Idris of Kogi State. The five Governors are all members of People's Democratic Party (PDP)

The judgement came as a result of an appeal of tenure expiration filed by INEC and Buba Marwa, who was a governorship candidate in the last election.

Meanwhile, Speakers of House of Assemblies of the affected would take over the affairs of running of the States in an acting capacity until elections are conducted in the States.

The Lagos State Police Command Special Anti-Robbery Squad, SARS, has arrested a 37-year suspected smuggler in army uniform.

The suspect, Joseph Chinukwe, was arrested in Ajangbadi along Lagos-Badagry Expressway, Lagos State, Southwest Nigeria.

Speaking with our correspondent, Chinukwe, who is undergoing interrogation, said: “I reside at 3, Epetedo Street, off Capitol bus stop, Ajangbadi. I’m not a robber, I left my car at the filling station. My car had a fault, so I had to park it at the filling station because I always buy fuel at the station.

“When I got to the spot, I didn’t see the car where I parked it and I decided to ask the attendant. Iwas later arrested after much interrogation, I had to confess that I am a civilian.
“I only use military uniform to smuggle goods like rice from Benin Republic and some times, I carry passengers from there.”

P.M.NEWS gathered that a worker at the filling station in Ajangbadi reported to the police that robbers allegedly carted away millions of naira and killed a guard.

The robbers came in a Peugeot 504 saloon car and the car was found parked at the same spot few days after the incident.

Suspicious of the car, the filling station attendant decided to inform the police at Ajangbadi Divisional Police Headquarters.

During investigation, policemen discovered a bag containing eight army uniforms in the car.
The officers then laid ambush for the owner to come for the bag. It turned out to be Chinukwe. When he did, he was arrested.
